Move-Out Cleaning and Getting a Texas Deposit Back

The deposit argument is almost never about whether the place was clean. It is about who can show what, and when.

Tenants tend to think a deposit is withheld because a property was dirty. Landlords tend to think it is disputed because tenants do not read the lease. In practice most of these arguments come down to evidence and timing, and both are things you control.

This is a practical guide rather than legal advice, and a lease can impose obligations beyond what the law requires. If real money is at stake, read your lease and get proper advice.

What Texas law actually requires

Under the Texas Property Code, a landlord has to refund a security deposit, or give you a written itemized description of what was deducted and why, within thirty days of you surrendering the property. That clock does not start until you have given a forwarding address in writing.

The forwarding address is the part people miss, and it is the cheapest mistake to avoid on this entire page. No address, no clock, and nothing to hold anybody to. Put it in writing, keep a copy, and send it in a way you can prove.

The other principle worth knowing is that a landlord cannot keep the deposit for normal wear and tear. That phrase is doing an enormous amount of work, and it is where nearly every dispute lives.

Where wear and tear ends

The rough line is deterioration from ordinary use on one side, and damage or neglect on the other. Carpet flattened along a hallway after three years is wear. A carpet with a stain nobody treated is not.

Cleaning sits awkwardly across the line, because grime accumulates through ordinary use and is also entirely removable. That is why cleaning charges are the most commonly disputed item on an itemized list and the hardest to argue about after the fact.

A useful test before you hand back the keys: could a reasonable person walk in and tell that somebody had made an effort? Ovens, showers and cabinet interiors are where that judgement gets made, because they are where a quick pass and a real clean look completely different.

What actually turns up on an itemized list

Deduction lists are more predictable than people expect. The same handful of items appear again and again, and almost all of them are cleaning rather than damage.

The recurring items

  • Oven interior, including the door glass and the racks
  • Refrigerator interior, and the seal around the door
  • Range hood filter, which is almost never cleaned by a departing tenant
  • Cabinet and drawer interiors, particularly under the sink
  • Shower glass, tracks and grout
  • Toilet base and the wall behind it
  • Blinds, slat by slat
  • Window tracks and sills
  • Baseboards, and the tops of door frames
  • Garage floor and any oil marks on the driveway

Photographs beat invoices

An invoice from a cleaning company proves you spent money. Photographs prove the condition you left the property in, and that is the thing actually in dispute.

Take them after the clean and after the property is empty, with the lights on, in daylight, and take far more than feels sensible. Wide shot of each room, then close shots of every item on the list above. Date-stamped is better. Video walking through works too and takes four minutes.

If you did have a professional clean, keep the invoice as well, because the combination of an invoice and photographs is very difficult to argue with. On its own the invoice tells a landlord that a company attended, not what it achieved.

Timing: the clean goes after the truck

A move-out clean has to happen when the property is empty. Cleaning around furniture and then moving it out defeats the whole exercise, because everything the furniture was hiding is now the first thing an inspector sees.

That is inconvenient, because the empty window is usually short and usually the same day something else is happening. Book the clean before you book the movers if you can, since cleaning companies have less flexibility on a fixed date than most people expect.

Where a lease ends on a hard date, work backwards from the inspection rather than forwards from the move. An excellent clean the day after the walkthrough is worth nothing at all.

When paying somebody is worth it, and when it is not

It is worth it when the deposit is meaningfully larger than the cost of the clean, when the property has an oven and a shower that have had a hard few years, or when you simply do not have a free day in the window between empty and handover.

It is not worth it for a small studio you have kept well, where two focused hours of your own will produce the same outcome. Nobody selling cleaning should pretend otherwise.

What tips it, more often than the arithmetic, is deadline risk. If the handover date cannot move and you have one evening, the calculation stops being about cleanliness and starts being about whether the job gets finished at all.

Common questions

Can a landlord charge for cleaning even if I cleaned?

They can propose a deduction, and you can dispute it. This is exactly why the photographs matter: without them the conversation is your recollection against their itemized list. With them it is a much shorter conversation.

Does a professional clean guarantee the deposit back?

No, and be wary of anybody who says it does. A clean deals with cleanliness. It does nothing about unpaid rent, damage, unreturned keys or anything else your lease allows to be deducted.

What if the property was not clean when I moved in?

Then you are relying on move-in evidence, which is why photographs on the way in matter as much as on the way out. If you have them, raise them early and in writing rather than at the point the deposit is withheld.

Rather hand it over?
